In 2022, the FTC took action against Epic Games, the creator of Fortnite, over allegations of deceptive practices within the game. The primary concerns included the use of “dark patterns,” a term used to describe manipulative design strategies aimed at encouraging players to make unintended purchases. Additionally, the FTC accused Epic Games of allowing minors under the age of 13 to make in-game purchases without obtaining parental consent, a direct violation of federal privacy laws.

The Settlement:

Epic Games, in response to these allegations, agreed to a substantial settlement. As part of the settlement, Epic Games will contribute $245 million towards refunds for affected players, alongside a $275 million payment to the US government to settle the COPPA (Children’s Online Privacy Protection Act) violations. This settlement underscores the company’s commitment to rectify its practices and protect the rights of players.

Eligibility for a Refund:

The FTC has identified specific categories of Fortnite players who may be eligible for a refund:

Unwanted Purchases: Players who were charged in-game currency for items they did not intend to purchase between January 2017 and September 2022.

Unauthorized Child Purchases: Parents whose children made in-game purchases on their credit cards without their knowledge, occurring between January 2017 and November 2018.

Account Locks After Complaints: Users whose Fortnite accounts were locked between January 2017 and September 2022 after they reported unauthorized charges to their credit card companies.

How to File a Claim:

To initiate the claims process, visit the claim site provided by the FTC, which can be found at www.ftc.gov/Fortnite. You will need either a claim number, sent to eligible players by the FTC via email, or your Epic Account ID.

Refund Amount:

The exact refund amount per individual remains undisclosed as it depends on various factors, including the number of players who file claims.
